The Environmental Damage Regulations apply in relation to the prevention and remediation of environmental damage.
Environmental damage is damage to:
- protected species or natural habitats, or a site of special scientific interest
- surface water or ground water, or
- land
Regulation 14 stipulates that an operator of an activity that has caused environmental damage, or has caused damage where there are reasonable grounds to believe that the damage is or will become environmental damage, must immediately take all practicable steps to prevent further damage and notify the enforcing authority.
