Dog control: Public Space Protection Order


Background

Isle of Anglesey County Council is responsible for the management and maintenance of public spaces across the island. 

We understand that dogs need to be exercised and have several parks, beaches and open spaces for dog walkers to take advantage of. Most owners are responsible and clean up after their dogs have fouled. We do not want to prohibit responsible owners from enjoying our open spaces.

However, there is growing concern about dogs across Anglesey, specifically in relation to dog fouling.

Public Spaces Protection Order (PSPO)

Isle of Anglesey County Council has the authority to implement a Public Spaces Protection Order (PSPO) under the Anti-Social Behaviour Crime and Policing Act 2014.

  • A PSPO can prohibit or restrict certain activities and is designed to ensure that the law-abiding majority can use and enjoy public spaces.
  • It keeps people safe from such anti-social behaviour as the failure to clear-up after dog fouling.
  • A PSPO would replace the outdated byelaws and restrictions that are currently in place.
  • The PSPO can last for three years and if breached, an authorised officer could issue a fixed penalty notice of up to £100, which, if not paid, could be increased to £1,000. ​

The proposal

This consultation asks residents for their views on a new proposed dog control PSPO for Anglesey.

The need for a dog control PSPO has arisen due to ongoing complaints about dog related anti-social behaviour issues, such as fouling and dog walking in banned areas such as certain beaches. These issues have a detrimental effect on the residents of and visitors to local communities.

The proposed PSPO will be applicable to specific areas of Anglesey.

Main objectives of the PSPO

  • Ensure and encourage responsible dog ownership in Anglesey and allow the council to have the ability to tackle dog related antisocial behaviour
  • Prevent dog fouling, which is unpleasant and can have dangerous effects such as toxocariasis, which can lead to blindness
  • Formalise the exclusion of dogs from areas designated for other priorities, such as beaches.
  • Allow those who breach a PSPO to be issued with fixed penalty notices should they choose not to comply with reasonable instructions from officers such as picking up after their dog has fouled or removing their dog from restricted areas.
  • The proposed PSPO will be valid for three years and will be reviewed after this period. 

The requirements and prohibitions imposed by this order shall not apply to any person who:

  • has a disability within the meaning of the Equality Act 2010 and whose disability restricts their ability to comply with the order where their guide dog or assistance dog, which they rely on, has been trained by an appropriate registered charity, or
  • is using a working dog for purposes of law enforcement, military duties, or statutory emergency services (search and rescue)

What the draft dog control PSPO includes

The draft will include ‘dog fouling of land’ prohibition, which makes it an offence if dog owners do not remove their dog’s faeces from land within all public highways in areas within the boundaries where the highways are subject to a 30mph or 20mph speed limit.

This includes the carriageways and adjoining footways and verges. It also includes:

  • all public open land within designated areas including school land and school playing fields and other playing fields and public cemeteries; and
  • all school land and public playing fields which are located outside such areas; and
  • land designated specifically, which includes beaches:

    • Llanfaelog
    • Traeth Llydan Rhoscolyn
    • Borth Wen Rhoscolyn

    • Porth Dafarch
    • Traeth Newry
    • Traeth Penrhos Holyhead
    • Porth Penrhyn Mawr Llanfwrog
    • Porth Tywyn Mawr
    • Porth Trefadog
    • Porth Trwyn Llanfwrog
    • Porth Swtan
    • Cemlyn

Land exempt from the draft order includes:

  • private land
  • highways that are subject to a 40mph speed limit or higher
  • woodlands
  • marshlands
  • moorland / heathland

Prohibit taking or permitting the dog to enter or remain in the designated areas in the following beaches between 1 May and September 30 in each year.
